Position Summary

The Deputy County Counsel series describes levels of positions involved in performing varied professional legal work in the field of civil law, specifically: prepares legal opinions; acts as legal counsel to assigned County departments and districts; represents the County or individuals in court; performs related duties as required.

This is the fully qualified working level of the Deputy County Counsel series. Incumbents perform difficult and complex legal work of assigned agencies with considerable latitude for independent action. Written opinions are reviewed by supervisory staff. This class is distinguished from the next higher class of Supervising Deputy County Counsel by the latter’s full supervisory responsibility for a functional unit and assigned staff.

Duties and Responsibilities

1. Confers with and advises assigned County agencies, departments, boards, commissions, and various special and school districts on legal matters pertaining to their respective powers, duties, functions and obligations; represents the same in a variety of meetings and hearings.

2. Prepares written opinions and renders informal opinions on legal questions.

3. Researches and drafts ordinances, contracts, agreements, resolutions and other legal documents; reviews same for legality.

4. Prepares for trial or hearings before trial and appellate courts and various administrative bodies as required; prosecutes claims and lawsuits on behalf of the County, and defends suits against the County, districts and employees.

5. Prepares and files legal documents with the court, including petitions, briefs and appeals.

6. Studies, interprets and applies statutes, ordinances, court decisions and legal opinions.

7. Drafts proposed legislation, analyzes pending legislation and recommends County positions on legislation.

8. Provides vacation and temporary relief as required.

Qualifications and Prior Experience

License: Active membership and in good standing with the State Bar of California.

Experience:

Juvenile Dependency Attorney IV: Forty eight (48) months of experience as an attorney, of which thirty six (36) months was handling juvenile dependency cases.

Juvenile Dependency Attorney III: Thirty (30) months of experience as an attorney, of which eighteen (18) months was handling juvenile dependency cases.

Juvenile Dependency Attorney II: Twelve (12) months of experience handling juvenile dependency cases.

Note: Experience as a Juvenile Dependency Attorney includes experience as a County Counsel, Minor’s Counsel, or Parent’s Counsel.

Desired Qualifications: Experience handling juvenile cases in San Bernardino County Dependency Court is highly desirable.
