The City Attorney defends Oakland’s interests and resources in court, protects and advances the rights of all Oaklanders and initiates legal action to secure compliance with applicable laws, justice and equity. We propose, draft and review ordinances and resolutions and sponsor legislation, often with members of the City Council and/or the Mayor. We strategically negotiate major agreements and contracts and help to shape Oakland’s policies. And we provide expert legal advice to City leaders and officials including the Mayor, City Council, City Auditor, City Administrator and City departments, boards and commissions.
The Oakland City Attorney’s Office seeks a well-qualified attorney to serve as Deputy City Attorney II or III – Rent Adjustment Program (“DCA-RAP”), with placement depending on experience.
The DCA-RAP will provide advice and counsel in practice areas including rent regulations and landlord/tenant law (such as evictions, renting and remedies), code enforcement, public nuisance, administrative hearings, affirmative litigation and constitutional issues (such as due process, equal protection, privileges & immunities, right to travel and residency requirements). The DCA-RAP also will provide advice on a wide range of issues such as conflicts, ethics, contracting, and drafting and researching legislation, regulations and policies.
Experience providing advice to Boards/Commissions and/or City Councils, ordinance and regulation drafting, administrative procedures (including administrative remedies and rule-making) and litigation (including writs, appeals and affirmative litigation) is a plus. Knowledge and expertise in municipal law also is a plus.
