Position Summary
As a member of the legal team supporting Abbott Diabetes Care, a CES 2022 Best of Innovation winner, the attorney will provide legal guidance to a fast paced, patient-centric, and dynamic business unit across a variety of legal topics and geographies. The individual will collaborate with research & development, purchasing, supply chain, clinical, regulatory, quality, business development, marketing, and sales functions to provide top notch legal advice and drive positive outcomes for Abbott and the people who rely on its products. This individual will be part of a larger Commercial Legal Operations team and work across Abbott divisions to build and grow successful relationships with outside attorneys and professionals, business partners, and customers. This position reports to Senior Counsel, Abbott Diabetes Care.
Duties and Responsibilities
•  Provide legal counsel to Abbott’s Diabetes Care team on compliance, risk management, and other legal issues in the context of federal and state regulatory requirements, including fraud and abuse laws, Anti-Kickback issues, Sunshine law, False Claims Act and Foreign Corrupt Practices Act.
• Participate in the preparation and negotiation of major commercial contracts and agreements with suppliers, researchers, hospitals, GPOs, governmental entities, and health care professionals.
• Advise marketing and commercial teams on advertising and promotional practices, claims, social and digital media guidelines, engagement with influencers and celebrity endorsements, including with respect to Federal Trade Commission and other regulations.
• Facilitate Abbott’s business objectives by providing practical, timely, and effective legal support, while minimizing potential legal risks.
• Supervise and direct outside counsel as needed.
• Work in close cooperation with Abbott’s compliance and privacy organizations to coordinate and streamline efforts.
• Identify training needs and assist in development and presentation of training and education regarding legal requirements and developments.
• Develop a thorough understanding of and familiarity with: Abbott’s business, its people, products, markets, facilities, customers, and competitors, and use this knowledge in providing guidance and counsel to the Abbott Diabetes Care team.
• This position will interact with the Legal, Compliance, Privacy, Finance, Purchasing, Supply Chain, Research & Development, Regulatory, Quality, Clinical, Marketing, Sales, and Information Technology Departments.
• Infrequent and minimal travel may be required (10-15%).

Qualifications and Prior Experience
Training/Experience Required:
• Possess a Juris Doctor degree from an accredited law school, demonstrate a strong academic background, and be admitted to a US state bar in good standing.
• Five or more (5+) years of experience as a commercial attorney at a top law firm and/or in-house, including the provision of legal advice on commercial matters and/or drafting/editing commercial contracts.
• Ability to handle multiple projects in fast-paced environment and exercise sound commercial and legal judgment.
• Strong process and analytical skills.
• Excellent problem-solving ability.
• Excellent time management skills and ability to manage competing priorities while ensuring timely completion and follow up.
• Ability to work independently and prioritize multiple projects for the reporting relationships.
• Must be adept at follow up and collaboration.
• Dynamic, proactive and mature.
Preferred Experience:
• At least five (5) years of progressively more responsible work experience in the health care industry, at a top law firm, or in-house and working.
• Experience representing an FDA-regulated company, including knowledge of corporate law, fraud and abuse laws, Anti-Kickback law, Sunshine Law, AdvaMed Code, HIPAA, and other laws and regulations pertaining to the pharmaceutical or medical device industry.
• Medical device, digital health, pharmaceutical or other health care business experience, and/or hospital/health system experience.
• Demonstrated ability to understand and comply with applicable FDA regulations and company operating procedures, processes, policies, and tasks.
